Controls for commodity exchange and return
Article (24)
The following rules shall be applied in regulating the exchange and return of products and goods:
- The consumer has the right to replace or refund the goods and recover their paid value within a period of fourteen days from the date of purchase, unless the condition of the guarantee declared by the merchant is included or the custom requires a longer period.
- Goods must be returned in cases in which a defect or defect is discovered, even if it is possible to fix it or if it does not comply with the standard specifications adopted within the State of Kuwait.
- In the event that the commodity or merchandise cannot be replaced, it must be returned, and the seller must refund its price according to the value contained in the sales invoices, in the same way that was used when buying or in any other method acceptable to the consumer.
- The right of the consumer to exercise the right of return or exchange does not lapse when the conditions set forth in this regulation are fulfilled even if the goods or goods were purchased during commercial offers (sales) authorized by the Ministry of Trade and Industry, and in this case the refund of the price shall be considered as the value of the commodity contained in the sales invoices. The same method was used when purchasing.
- If it becomes evident that the commodity or the merchandise subject to return or exchange is fraudulent, imitated or not in conformity with the mandatory standard specifications approved in the State of Kuwait, the consumer shall have the right to recover its value from the seller in cash without prejudice to his right to take the legal procedures established in this regard, according to the case, against the violating seller.
- If the reason for the replacement is related to the sizes, the buyer must exercise the right of replacement or return within a period not exceeding five days, and in the absence of the alternative size, the consumer is entitled to directly the option of returning and recovering the value of the commodity, provided that the measurement option is proven in the purchase invoice.
Article (25)
The consumer may not directly have the right to return or exchange options in the following cases:
- If the consumer is aware of the defect or defect in the commodity when purchasing it and accepts it in its condition and this has been proven in the purchase invoice.
- If the commodity or merchandise transforms its nature, characteristics, or method of packing or packaging without replacing it or returning it, such as exposing it to damage or the impossibility of returning it to the condition it was in at the time of purchase in a way that prevents resale unless the reason for the return and replacement is due to manufacturing defects or irregularities. Mandatory standard specifications, or the goods or goods are contrary to what has been agreed upon as a result of fraud in the specifications and components.
- Perishable consumer goods are excluded, unless they are proven to be spoiled or expired for human consumption on the date of purchase, or goods that are manufactured according to specifications set by the consumer, books, newspapers and magazines.
Article (26)
- The supplier is obligated to return the commodity with a refund, exchange or repair without charge in the event that a defect is discovered or it is not in conformity with the established standard specifications or the purpose for which it was contracted within the specified period in accordance with the terms of the guarantee declared by the merchant or the period for which the custom was made.
- The provisions of this text do not apply to perishable consumer goods, goods that are manufactured according to consumer specifications, books, newspapers and magazines, computer programs and the like.
